Inercja legislacyjna w dobie nowych technologii. Biocomputing jako symptom systemowej dysfunkcji prawa

W artykule podjęto problematykę inercji legislacyjnej jako immanentnej cechy systemu normatywnego w kontekście przełomowych innowacji technologicznych. Biocomputing, czyli przetwarzanie informacji przy użyciu systemów biologicznych, służy jako studium przypadku ukazujące nieprzystawalność istniejących kategorii prawnych do zjawisk wymagających regulacji. Analizą objęto prawo unijne i prawo polskie. Zidentyfikowano cztery zasadnicze luki normatywne: brak właściwej kategorii prawnej dla biokomputera, nieadekwatność reżimu bezpieczeństwa biologicznego, kolizję reżimów własności intelektualnej oraz nierozstrzygniętą kwestię danych genetycznych jako nośnika informacji obliczeniowej. Sformułowano postulaty de lege ferenda dotyczące zarządzania nieuchronnym opóźnieniem prawa, w tym postulat ustawy ramowej, ratyfikacji konwencji z Oviedo, powołania interdyscyplinarnej rady eksperckiej oraz reformy kształcenia prawniczego.
